These terms govern the relationship between Legado de Valor and the families or representatives who use our compensation file management services for families of soldiers killed in Ukraine. Reading them in full and expressly accepting them is an essential requirement for the provision of the service.

2. Service Description
Legado de Valor provides legal and documentary intermediation services for families of soldiers killed in Ukraine who wish to claim the compensation provided for under applicable Ukrainian legislation during martial law. The service includes, on a non-exhaustive basis: initial viability assessment at no cost to the client, documentation guidance, full file preparation and coordination, apostille and sworn translation management, power of attorney processing, submission of the file to the competent Ukrainian authorities, active follow-up and handling of additional authority requests, and assistance during the payment phase upon file approval.
3. Fee Model — 20% Commission
3.1 Percentage and accrual
Legado de Valor is entitled to a commission of twenty per cent (20%) of the total gross amount of the compensation approved and disbursed by the Government of Ukraine in favour of the beneficiary or beneficiaries, regardless of the number of recognised beneficiaries and the individual amount each one receives.
The commission shall only accrue when the following two conditions are simultaneously met:
- A favourable resolution granting the compensation has been issued and notified by the competent Ukrainian authorities.
- Effective disbursement of at least one payment has been made by the Government of Ukraine to the beneficiary or beneficiaries.
If the file is definitively denied or fails to progress for reasons beyond Legado de Valor's control, no fee shall accrue and the client shall have no payment obligation whatsoever.
3.2 Proportionality to the government payment schedule
The Government of Ukraine may disburse the compensation in a single payment or in instalments according to the schedule established by the competent authorities. In either case, the 20% commission shall apply and become due proportionally and simultaneously with each governmental disbursement, as follows:
- For each partial payment made by the Government of Ukraine to the beneficiary or beneficiaries, Legado de Valor shall receive 20% of that partial payment, on the same date or within a maximum of five (5) business days from the beneficiary's receipt of the payment.
- In the case of a single payment, the full 20% commission shall be due within a maximum of five (5) business days from receipt of payment.
- The beneficiary or beneficiaries are obliged to notify Legado de Valor of any payment received from the Government of Ukraine within a maximum of two (2) business days from receipt.
3.3 Multiple beneficiaries — Joint and several payment liability
Where the compensation is recognised in favour of multiple family members or beneficiaries, the 20% commission shall be calculated on the total amount of the recognised compensation and distributed proportionally among them according to the share each beneficiary receives.
Notwithstanding the foregoing, the following joint and several liability clause is expressly established:
- If one or more of the recognised beneficiaries refuses to pay the 20% commission corresponding to the share of compensation recognised in their favour, the unpaid amount shall be assumed jointly and severally by the remaining beneficiaries who are receiving or have received the compensation as a result of Legado de Valor's management.
- Beneficiaries who assume joint and several liability for another beneficiary's default shall have a right of recourse against the defaulting beneficiary for the amount paid on their behalf.
- For the purposes of this clause, all beneficiaries who have signed or consented to Legado de Valor's service provision — directly or through a representative — are bound by this joint and several obligation.
This joint and several liability clause is intended to ensure that Legado de Valor receives its full 20% commission on the total compensation disbursed, regardless of the individual conduct of each beneficiary.
3.4 Calculation basis
The commission shall be calculated on the gross amount of each governmental payment, before any tax, banking or other deductions that may be applied by the Government of Ukraine or any intervening financial institutions. Where payment is received in a currency other than UAH, the applicable exchange rate shall be the official rate of the National Bank of Ukraine on the date each payment is received.
3.5 Formalisation of the fee agreement
The 20% percentage described in this clause constitutes the base fee agreement arising from acceptance of these terms and conditions. Prior to the commencement of the formal legal procedure, Legado de Valor and the client shall enter into a specific service agreement expressly recording this percentage, the reference amount of the recognised compensation, the payment schedule agreed with the authorities, and any other particular conditions of the case. In the event of any conflict between such specific agreement and these general terms, the specific agreement shall prevail.
4. Service Limitations
- Legado de Valor does not guarantee approval of the compensation, the resolution of which depends exclusively on the Ukrainian authorities and the documentation actually provided and verified.
- Legado de Valor does not replace the role of a registered lawyer and does not provide independent legal advice in the technical sense. Its services are documentary, coordination and intermediation in nature.
- Reference amounts (15,000,000 UAH / ~USD 362,000) are indicative and subject to change depending on current regulations, exchange rates and the specific verified circumstances of each file.
- Legado de Valor is not responsible for the processing timelines of Ukrainian authorities, which are beyond its control and may be affected by the martial law situation.
5. Client Obligations
- Provide truthful, complete and up-to-date information about the case in all its aspects.
- Supply required documentation within agreed timeframes.
- Promptly notify any relevant changes: new representative, death of another beneficiary, resolution received directly from the authorities, communications from Ukrainian authorities, or any other fact that may affect the file.
- Not to file the same claim simultaneously with other entities or intermediaries without prior express notification to Legado de Valor.
- Notify Legado de Valor of any payment received from the Government of Ukraine within a maximum of two (2) business days of receipt.
- Pay the 20% commission as set out in section 3 of these terms.
6. Confidentiality
Legado de Valor treats all file information with absolute confidentiality. Staff and collaborators are bound by confidentiality agreements. Data is only shared with third parties to the extent strictly necessary for file management: Ukrainian authorities, translators, notaries and collaborating lawyers.
7. Liability
Legado de Valor shall not be liable for damages arising from: (i) false or incomplete information provided by the client; (ii) documentation that proves invalid, false or insufficient; (iii) unfavourable decisions by Ukrainian authorities; (iv) delays in Ukrainian administrative or judicial proceedings; (v) subsequent regulatory changes.
8. Governing Law and Jurisdiction
These terms are governed by Ukrainian law, in particular the Civil Code of Ukraine and the regulations applicable to service contracts, without prejudice to the rights granted by EU consumer protection law to clients resident in EU member states. Any disputes arising from these terms shall be submitted to the competent courts of Kyiv (Ukraine), unless mandatory consumer protection legislation in the client's country of residence establishes a different jurisdiction.
9. Amendments
Legado de Valor reserves the right to amend these terms when necessary. Amendments will be published on this page with the date of update. Continued use of the service after publication of amendments implies acceptance thereof. For files already in progress, relevant changes will be communicated by email.
